The Official Rules and Regulations of the Dream Home Makeover Raffle are set forth below. By entering the raffle, all entrants agree to be fully and unconditionally bound by these Official Rules and Regulations, waive any right to claim ambiguity in the raffle or these Official Rules and Regulations, and further agree to be bound by Dream House Charity's decisions and interpretation of these Official Rules.
ELIGIBILITY: Anyone 18 years of age or older may enter. All federal, state and local laws and regulations apply. Employees and members of the Board of Directors of Manatee Children's Services, employees of their agents, consultants, attorney, their spouses and children living in the same household are excluded from participating and are not eligible. This is not a lottery; this is a drawing by chance. All federal, state and local laws associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner. The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions
ENTRY: A maximum of 4500 tickets will be sold. By entering this raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth herein, and, (2) that their names and/or likeness may be disclosed to and used by the news media and may, otherwise, be used by Dream House Charity for publicity purposes. The winners name and/or likeness may be published in newspapers and announced on the Dream House Charity website. Other rules and regulations may apply. Dream House Charity's interpretation and application of the rules and regulations shall be final. No contribution necessary. By entering this raffle, each participant releases Dream House Charity, its employees, founders, owners, directors, officers, agents or any sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, shareholders, members, representatives, or independent contractors or any of its affiliates from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning any prize or resulting from acceptance, possession, use or misuse of any prize. The winner also agrees to defend, indemnify and hold Dream House Charity, and/or sponsors and each of their respective officers, directors, shareholders, employees, agents and affiliates and identities harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of participating in the raffle or the winners acceptance or use of any prize.
Dream House Charity WILL NOT share, sell, or otherwise distribute personal information collected by sponsor except as stated above.
TICKETS: Tickets are $50.00 each (U.S Dollars) suggested minimum donation. Payment methods accepted are credit cards, personal checks or money orders, made payable to Manatee Children’s Services. Tickets may be purchased online or, by using the order form provided on this website and mailed to P.O. Box 14427, Bradenton, FL 34280-4427. Mailed ticket orders must be accompanied by a valid credit card number, expiration date, 3 digit security code (on back), and your name printed as it appears on the credit card and your signature, or by a check or money order. All Payments must be made payable to Manatee Children’s Services. Tickets may not be purchased via email or voicemail. As soon as payment clears your ticket(s) request will be processed. You will receive a ticket receipt in the mail. All tickets purchased before an entry deadline are included in the drawing even if the ticket receipt arrives after the drawing date. Please allow two weeks for delivery. Tickets will be sold on a first come first serve basis. You may purchase a maximum of ten (10) tickets, subject to availability. Each ticket can only be purchased in the name of one person. If more than one name appears on a ticket entry form, then the first name listed will be deemed the purchaser of that ticket. Dream House Charity will reject any ticket order if the check or credit card payment is not honored or returned for insufficient funds. The ticket receipt(s) will be mailed to the name and address on the entry form. Tickets may not be changed, sold or transferred by the purchasing party or anyone else without the express written approval of Dream House Charity at its sole discretion. Tickets must be purchased and paid for by 5:00 p.m. on the day of the specified deadline. If 3000 raffle tickets have not been purchased and paid for by the specified date, then the date may be extended at Dream House Charity's sole and absolute discretion and without prior notice, in which case the drawing for the prize will occur 15 days after the extended ticket purchase deadline, subject to these Rules.
REFUNDS: All ticket sales are final. No refunds will be made except under the following circumstances: Any ticket order with payment received after 4500 tickets have been sold. No other refunds are available. A raffle participant's sole and exclusive remedy for Dream House Charity's breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall Dream House Charity, its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits, or goodwill, or for any incidental, special punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages. Dream House Charity assumes no responsibility for printing errors in any raffle-related material, or for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadline. All entries become the property of Dream House Charity and will not be returned.
DRAWING: There will be a total of Twenty (20) Early Bird Prize Drawings for five (5) Free tickets per each drawing. Five (5) winning tickets will be drawn on the last day of each of the following months: July, September, November and January ending when tickets are sold out. The Dream House Drawing will be held 6:00 P.M. at Manatee Children’s Services, 453 Cortez Road West, Bradenton, Florida on June 12, 2012. IN THE EVENT OF AN EARLY SELLOUT, THE RAFFLE WILL END SOONER AND THE DRAWING WILL BE HELD 15 DAYS AFTER. The winning ticket will be drawn at random from all tickets purchased before the deadline stated in these Rules. Winner need not be present to win. Winner name, not ticket numbers, will be called. The winner will be called by name and verified by matching the ticket with the information in the records and the application form. The odds of winning are based on the number of tickets sold. The contest and drawing may be extended at the discretion of Dream House Charity but under no circumstances shall the contest and drawing be extended for more than ninety (90) days. If the contest is extended, the drawing will be extended for the same length of time. The drawing is open to the public. Winner will be notified by telephone, email and U.S. Mail according to the contact information provided at the time of ticket purchase. Notification by telephone will be made the day of drawing. Email and U.S. Mail notification will be made within 24 hours of drawing. In the event that Dream House Charity is unable to locate the winner within two weeks from the date of the drawing, after attempting to make contact through information provided at the time of purchasing the ticket, such winner will be deemed to have forfeited his or her prize and another winner will be selected for such prize. In addition, an announcement of the name of the winner will be posted on the Dream House Charity website. In order to collect his or her prize, the ticket winner must sign and deliver to Dream House Charity: (a) a sworn affidavit of eligibility in accordance with these Rules and applicable law, including without limitation that he or she is at least of 18 years old; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; (c) proper identification proving that the person claiming the prize is the same person who is named on the winning raffle ticket. Winner must execute all required documentation to transfer title of property into his or her name, within thirty (30) days of prize notification. In the event any selected entrant is found ineligible or forfeits the prize, as described in these Official Rules, an alternate drawing will be held within five (5) business days after verification. If the selected entrant is found ineligible, rules of alternate drawing governed by these Official Rules, and notification will be posted on the website immediately.
PRIZE DETAILS: Winner shall have the choice of selecting a fifty thousand ($50,000) Dream Home Makeover, by Bruce Williams Homes or fifty thousand ($50,000) cash. Winner shall only have cash as prize option should winner reside outside of Manatee or Sarasota counties. Manatee Children's Services, Dream House Charity or, any of their employees, affiliates, agents or assigns, will not nor do hereby offer any legal, tax, real estate, or gifting advice. The winner is advised to seek professional legal, tax, investment and real estate advice prior to the purchase of a contest ticket. Winner agrees to hold Dream House Charity harmless in any dispute arising over any representations concerning the value of materials used, labor, overhead, or any other costs associated with the grand prize, Dream Home Makeover by Bruce Williams Homes. Actual prize may vary from photos used in print or displays. Model home interior decorating and furnishings and artists renderings are for display purposes only and are not included as part of the prize. No warranties or representations of any kind, expressed or implied are made by Dream House Charity. Event organizer reserves the right to offer additional prizes. In the event that organizer exercises said right, the grand prize shall be drawn first with all additional prizes drawn subsequent to grand prize being drawn.
PRIZE AWARD IN THE EVENT OF NON-SELL OUT OF TICKETS: Rules as stated above shall apply except as follows: In the event that less than 3000 tickets are sold, then the winner will be awarded a cash prize equal to 50% of net raffle proceeds at that time. For the purpose of these rules, net proceeds are defined as the balance of ticket sales revenue remaining after payment of all raffle-related fees and expenses. The net proceeds will then be divided equally between Manatee Children's Services and the winner based on Dream House Charity's accounting, which shall be final and conclusive with respect to the winner. In the event that an accounting more detailed than that required to be filed with the Department of State is requested to be produced by Dream House Charity, the requesting party shall be responsible to prepay the costs of same in the amount of seven thousand ($7,000.00) dollars, not to exceed ten thousand ($10,000.00). Dream House Charity reserves the right to end the raffle at any time for any reason at its sole discretion. In that event, the winner will be awarded a cash prize equal to 50% of net proceeds at that time.
